"It's far too common for the authorities to simply try to find an alternate charge if they could not bring anything to bear on you for the "primary" investigation. The story/scenario there is a nightmare in the making if taken to its' logical extension...think of people with personal machine shops or Shopsmiths being randomly investigated or arrested because they *might* be able to make an AK-47 or 74."
